At first blush, the 6 workers injured at the We Energies Oak Creek facility would be limited to Workers Compensation to collect for their injuries.  However, often times workplace injuries are the result of negligence by so-called third parties, meaning not the injured or the employer, but by a 3rd party responsible for the injuries.
The [...]

By Jon P. Groth • Feb 3rd, 2009 • Category: Civil Litigation, Newest Post, Personal Injury Law

The Wisconsin Lawyer Magazine has a quick read entitled Politics in Civil Jury Selection.  Very interesting.
This is one of the more important parts of my job.  Who should I keep on a jury?  What questions do I ask in order to figure out who would make a good juror for a particular set of facts. Who will [...]

What are my damages in a Breach of Contract Lawsuit?

By Sean M. Sweeney • Jan 28th, 2009 • Category: Business Law, Civil Litigation, Newest Post

In many litigation cases, the question is not, “was there a breach”, but rather “what are my damages.” As smart business people, the decision must always be what is my likelihood of success combined with my likely award. Unfortunately, there are many times when one party is as right as rain, but if the damages [...]

In Brew City Redevelopment Group, LLC v. Ferchill Group 297 Wis.2d 606, the Wisconsin Supreme Court defines the economic loss doctrine as
“a judicial doctrine intended to preserve the fundamental distinction between contract and tort. It works to prevent a party to a contract from employing tort remedies to compensate the party for purely economic losses [...]

Choke On That Altria (f/k/a Phillip Morris)

By Eric M. Knobloch • Dec 18th, 2008 • Category: Civil Litigation, Newest Post, Personal Injury Law

This week the U.S. Supreme Court dealt a big-blow to big tobacco companies in its Altria Group Inc. v. Good decision.  The lawsuit allowed to proceed alleges widespread consumer fraud by Altria in its branding of “light” and ”lowered tar” cigarettes.
Using consumer law statutes against big business is not novel.  This Altria case is similar in form to the lead [...]

No, not Big Rod getting picked up by the Feds.  This one here and here involves one of the biggest and most successful Personal Injury Firms in the nation.   Says the Sun-Times:

Alice Griffin, a 42 year old Manhattan attorney, says she was at a Starbucks on Seventh Avenue when the clerk failed to put an insulating sleeve on the [...]

Medical Malpractice Snippet

By Eric M. Knobloch • Nov 25th, 2008 • Category: Civil Litigation, Newest Post, Personal Injury Law

An article in todays Pantagraphout of Bloomington, IL reports a rather boring medical malpractice jury verdict in favor of the plaintiff.   The jury found the hospital negligent and awarded the plaintiff a little over $700,000.  So boring is the article on its face that I spared you quotes.
However, the case is noteworthy for two reasons.  First, Bloomington, IL [...]
